The petitioner is languishing in custody since 30.11.2014 in a case registered for the offences punishable under Sections 3/4 of Explosive Substances Act and 17 of Criminal Law Amendment Act.
Four live bombs and some and some Naxal literatures were recovered from a bag kept in a bus leading to the registration of the present case against unknown. During investigation one Bharat Yadav suggested that the petitioner was carrying the alleged bag.
It is submitted by learned counsel for the petitioner that Bharat Yadav was on litigating terms with the
Patna High Court Cr.Misc. No.15491 of 2015 (02) dt.20-05-2015 2/2 petitioner and he did not suggest that the bag actually contains the explosives. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Rampur P.S.
