The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Jhanjharpur P.S. Case no. 95 of 2022 instituted for the offence under Sections 279, 379, 420/34 of the Indian Penal Code, Sections 3, 4, 4(B) of Bihar Animal & Preservation Improvement Act and Section 11 of the Prevention of Cruelty Act, Prosecution case relates to recovery of nine buffaloes from a vehicle bearing Registration No. BR-21GA-8650 which were alleged that they were stolen.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.48183 of 2022(2) dt.15-12-2022 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. A statement has been made in para 3 of the petition that he has got no criminal antecedent. It is further submitted that petitioner is the registered owner of the said vehicle from where buffaloes have been recovered and due to which the name of the petitioner has been came into light and falsely implicated in this case. The driver of the said vehicle has already been arrested on spot in respect of this offence. Petitioner has no concern at all regarding sell and purchase of the buffaloes.

Learned APP appearing for the state has opposed the prayer of anticipatory bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Jhanjharpur P.S. Case no. 95 of 2022, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Jhanjharpur, District- Madhubani subject to the conditions as
