The petitioner seeks bail in Masaurhi P.S. Case No. 28 of 2014, corresponding to Sessions Trial No. 934 of 2014, registered for the offences punishable under Sections 395 and 412 of the Indian Penal Code.

Three persons namely Mantosh Kumar, Himanshu Kumar and the petitioner Mahesh Yadav were apprehended with the pick up van from which the looted battery were being carried. Learned counsel for the petitioner submits that other two accused persons namely Mantosh Kumar and Himanshu Kumar have already been enlarged on bail vide orders passed in Cr. Misc. No. 22518/14 and Cr. Misc. No. 23642/14 and the case of the petitioner stands on the same footing.

No.8921 of 2015 (3) dt.02-04-2015 2/2 Considering the facts aforesaid and the fact that the petitioner has already remained in jail for more than 14 months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge XI, Patna in connection with Masaurhi P.S. Case No. 28 of 2014, corresponding to Sessions Trial No. 934 of 2014.
