JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-03-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 28.10.2014 in a case registered for the offences punishable under Sections 366 A, 120 B of the Indian Penal Code.
The victim has already returned to her home and her statement under Section 164 of the Cr.P.C. has been recorded. In her statement, she stated that she was taken away by the petitioner at different places and subsequently, she was brought to Patna where petitioner along with her was caught by the police. The contention on behalf of the petitioner is that the statement of victim reflects that victim and petitioner were in love and as a matter of fact, it is a case of simple elopement of the victim.
Patna High Court Cr.Misc. No.12417 of 2015 (2) dt.26-03-2015 The victim was medically examined and the medical board found her age between 17 to 18 years.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Khagaria in connection with Parbatta P.S. Case No. 253 of 2014.
