JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-11-2018 Learned counsel for the petitioner admits that the writ petition has lost its significance as the order of suspension which was under challenge in the present writ petition has since been revoked and the petitioner has retired from service after attaining the age of superannuation. The issue remains with regard to payment of salary for about four months to the petitioner for the period he was suspended.
The Court does not feel persuaded to enter into the merit of the claim of the petitioner's post retirement benefits in the present proceeding. However, liberty shall be available to the petitioner to agitate the matter before the appropriate authority for redressal of his grievance for non-payment of
Patna High Court CWJC No.21388 of 2012(12) dt.20-11-2018 2/2 salary and non-payment of post retiral dues. In case such grievance is raised by the petitioner by filing a representation along with a copy of this order, the respondents will consider and decide the same by a reasoned order within a period of four months from the date of filing such representation. With the aforesaid, the writ petition stands disposed of.
