The petitioner seeks bail in Excise Case No. 239 of 2019, instituted for the offence under Section(s) 30(a) and 56(b) of Bihar Prohibition and Excise (Amendment) Act, 2018. It is alleged in the written report that 350 litres of Mahua liquor has been recovered from vehicle. Petitioner is said to be driver of the aforesaid vehicle.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. He is in custody since 1.5.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let

Patna High Court CR. MISC. No.45234 of 2019(2) dt.25-07-2019 2/2 the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Gaya, in connection with Excise Case No. 239 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioner.
