JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-302, 120(B) & other minor sections of the Indian Penal Code.
Petitioners and other FIR named accused mercilessly,, assaulted the deceased with LATHI and DANDA. The postmortem report of the deceased reveals that the deceased received so many injuries on his person.
Although learned counsel for the petitioner tried to convince me about the false implication of the petitioner, arguing that police reached on the place of occurrence, having got

No.23942 of 2016 (4) dt.15-07-2016 2/2 information but the family members of the deceased did not disclose the name of the assailants but I am not, at all, convinced with the submission of learned counsel for the petitioners and, accordingly, their prayer for bail in connection with Cheraiya Bariyarpur P.S. Case No. 32 of 2016 pending in the court of learned Additional Chief Judicial Magistrate, Manjhaul, Begusarai, stands rejected, at least at this stage.
