JUSTICE BIRENDRA KUMAR ORAL ORDER 04-10-2021 Heard Mr. Ramakant Sharma, learned senior counsel for the petitioner and Mr. Satyendra Narayan Singh learned counsel for the informant as well as Mr. Shyam Kumar Singh, learned APP for the State.

The petitioner is languishing in custody for the offence punishable under Sections 447 and 302/34 of the Indian Penal Code.

The report of the trial Judge dated 03.08.2021 would reveal that only two official witnesses are to be examined on behalf of the prosecution. Rest of the witnesses have already been examined. In the past prayer for bail of the petitioner was refused on 04.02.2020.

Allegation against the petitioner and others is of

Patna High Court CR. MISC. No.16098 of 2021(3) dt.04-10-2021 2/2 indiscriminate firing causing death of the son of the informant. Petitioner is in custody since 16.09.2019.

Since the trial is at the verge of conclusion, I am not inclined to enlarge the petitioner on bail at this stage in connection with Phulwaria P.S. Case No. 93 of 2019. Hence, prayer is refused.

However, if the trial would not conclude within six months, learned trial Judge shall consider his identity for grant of bail to the petitioner without being prejudiced by this order. (Birendra Kumar, J) mantreshwar/- U T
