JUSTICE SUDHIR SINGH ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections147,148, 149, 323,324, 307, 379 and 504 of the Indian Penal Code and later on Section 302 IPC was also added. It is alleged by the informant that all the accused persons including this petitioner were abusing his nephew (Manish Kumar @ Rohan Kumar and when protest raised by his cousin son, on provocation of Pintu Kumar all the accused persons started to assault and due to assault the cousin of the informant was seriously injured. Thereafter the injured was admitted in Rajeshwar Hospital, Kankarbagh, Patna and during course of treatment the injured Manish Kumar @ Rohan Kumar died. Patna High Court Cr.Misc. No.24274 of 2016 (4) dt.08-08-2016 2/2 submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering of the witnesses against the petitioner. It is a case and counter case between the parties. Free fight is alleged to have taken place in course of playing of cricket. General and omnibus allegation has been made in the FIR. Co-accused, namely, Pintoo Kumar, has been granted bail on 20.05.2016 vide Cr. Misc. No. 22019 of 2016. On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, learned Judicial Magistrate,1st Class, Danapaur, DistrictPatna in connection with Maner P.S.Case No. 67 of 2016.
