JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody in connection with Silao P.S. Case No. 26 of 2016 for the offences instituted under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. The prosecution story, in brief, is that four stolen oxen are said to have been recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.02.2016. The charge sheet has been submitted. There is no allegation of tampering of witnesses alleged against the petitioner. No firearm is said to

Four theft oxen are said to have been recovered from the possession of the petitioner. The petitioner had no knowledge that the said oxen were theft one. The other co-accused has been granted bail vide Cr. Misc. No. 35871 of 2016.

On behalf of the State, it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Silao P.S. Case No. 26 of 2016.
