Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Shri Krishna Puri P.S. Case No. 201 of 2022 lodged under Sections 399 and 402 of the I.P.C. read with Sections 25(1b)a/26/35 of the Arms Act. As per prosecution case, the allegation of dacoity is there in the F.I.R. and case has been filed against 7 named accused persons.
Learned counsel for the petitioner submits that from the contents of F.I.R. the recovery has been made from the
Patna High Court CR. MISC. No.48231 of 2022(2) dt.24-12-2022 2/2 possession of other accused person but from the present accused person nothing was recovered and he is only a member of mob. He further submits that antecedent of the petitioner is clean, he is in custody since 25.05.2022 and charge sheet has already been filed in this case.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-cum-ACJM, Patna-IV in connection with S.K. Puri P.S. Case No. 201 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.. With this observation, the bail application stands allowed.
