The petitioner seeks regular bail in a case registered under Section 307 and other sections of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was added. The informant Thag Kushwaha named the petitioner along with other accused persons and alleged that Kailash Chaurasiya assaulted Baliram Kushwaha on his head with iron rod. Thereafter, the informant named many other persons including the petitioner and alleged that they, having armed with different weapons, came and assaulted the informant and others but the informant did not make any specific allegation against the petitioner that the petitioner assaulted anybody. On perusal of the record, it appears that of course the petitioner is named in the F.I.R. but no specific allegation of

Patna High Court Cr.Misc. No.11281 of 2015 (2) dt.18-03-2015 2/2 assault is made against the petitioner.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Bagaha, West Champaran in Dhanaha P.S.
