The petitioner seeks bail in connection with C2-135 of 2018/ 180/18 registered under Section 30(a) of Bihar Prohibition & Excise Act-2016.

18 lts. of Nepali Saufi wine is said to have been recovered from the bicycles of the petitioner and co-accused Lalbabu and they were apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has no concern with the seized liquor. He has been falsely implicated in the case at

Patna High Court Cr.Misc. No.23674 of 2018(2) dt.30-04-2018 2/2 the instance of his enemy. The seizure list does not indicate as to from whose bicycles, the aforesaid liquor was seized. He has no criminal antecedent. He has been languishing in custody since 2.03.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Session Judge-II-cum-Special Judge, Excise, Sitamarhi in connection with C2-135 of 2018/ 180/18.
