2. The petitioner is in custody since 01.04.2016 in connection with Udwant Nagar P.S. Case No. 263 of 2015 for the offences alleged under Sections 272/273 of the Indian Penal Code and Section 47A of the Excise Act.

3. It is submitted that the petitioner has been falsely implicated owing to political rivalry and the first information report has been lodged at the time of Assembly Election 2015. It is submitted that no recovery of the goods has been made from inside the house of the petitioner rather from his outhouse. The alleged occurrence as is said to have transpired was prior to the recent amendment in the Bihar Excise Act.

4. Having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the
