The petitioner apprehends his arrest in Chandauti P.S. case No. 02 of 2019 registered under Section 420, 406, 407, 467, 468 of the IPC.

The petitioner being a Revenue clerk of Town Circle, Chandauti, Gaya is alleged to have made interpolation with regard to land standing in the name of State of Bihar. The learned counsel for the petitioner submits that petitioner has already been dismissed from service. There is no material that petitioner made interpolation in Register-II. Jamabandi No. 348 II Mauza Parsawan was created vide Mutation Case No. 170/81 when petitioner was not posted as Revenue Clerk of Town Circle, Chandauti, Gaya and according to Mutation Act the duty of petitioner is only to make report

No.47311 of 2019(2) dt.30-07-2019 2/2 after verification of land and the Circle Officer is empowered to mutate the name of a person on the basis of report and mode of transfer of the land in the name of applicant. Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Chandauti P.S. case No. 02 of 2019, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
