In this application for anticipatory bail the petitioner apprehends his arrest in connection with Obra P.S. Case No. 118 of 2017 for the offence punishable under section 7 of the E.C. Act. Allegedly, the petitioner being P.D.S. dealer sold the supplied articles in the black market and during enquiry this fact has been ascertained.
Submission is of false implication and that due to village politics the petitioner has been implicated, the petitioner has been running the shop since 1992 but under collusion and connivance of some people this case has been lodged, there is no complaint against the petitioner, the petitioner has distributed the
Patna High Court Cr.Misc. No.44440 of 2017 (2) dt.22-09-2017 2/2 supplied articles as per the entry made in the supply register and as such the petitioner deserves sympathetic consideration. The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner.
In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M, Daudnagar, Aurangabad in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
