Mr.Anish Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 26-07-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Riga P.S. Case No. 96 of 2018, registered under Sections 341, 447, 323, 324, 307 and 504/34 of the Indian Penal Code. The accusation is that due to land dispute, petitioner and Ram Binod having spade and rod in their hands came at the land of informant, Sunita Devi on 30.03.2018 at about 10 P.M. and started to abuse her. When the informant made protest then Ram Binod Sah gave spade blow causing injury at her head. When her husband, Raghunath Sah, came to save her then Ram Binod Sah caused injury at his head and this petitioner also assaulted to the informant and her husband through iron rod.

No.46278 of 2019(2) dt.26-07-2019 2/2 Learned counsel for the petitioner submits that due to land dispute occurrence took place, in which, Ram Binod Sah, father of the petitioner, has also sustained injury. Moreover, the injuries as found on the person of the informant and her husband, are simple in nature and petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 96 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
