JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366, 366(A), 34 of the Indian Penal Code.

No doubt, the victim has not been recovered as yet but at para-12 of the case diary it has been mentioned by the investigating officer that when petitioner and some others were arrested, they disclosed that they helped co-accused, Deepak Kumar in taking away the victim. The other paragraphs of the case diary go to show that aforesaid co-accused, Deepak Kumar as well as victim had sweet relation. Moreover, the investigation against

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IV, Motihari, East Champaran in connection with Madhuban P.S. Case No. 05 of 2016.
