JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-03-2015 Petitioner is languishing in custody since 18.12.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act. It is alleged that from the possession of the petitioner one country made loaded pistol along with a stolen motorcycle were recovered.
It is submitted by learned counsel for the petitioner that the arms and motorcycle were left by one Raushan Kumar who is a co-villager of the petitioner but the police has maliciously apprehended the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent and the investigation has already concluded.
Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail
Patna High Court Cr.Misc. No.10708 of 2015 (2) dt.23-03-2015 2/2 bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 403 of 2014.
