JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 395 and 412 of the Indian Penal Code. It is alleged that on pistol point mobile phone and Rs. 7,000/- cash were robbed.

It is submitted on behalf of the petitioner that the petitioner is in custody since 30.04.2011. Charge sheet has already been submitted in this case. There is no allegation of tampering of the witnesses against the petitioner. The petitioner is not named in the FIR. His name has come on the basis of his own confessional statement before the police. The petitioner has not been put on T.I. parade. Other co-accused, namely, Shiv Chandan Kumar @ Chandan Kumar, has been granted bail on 30.01.2012 vide Cr.

Patna High Court Cr.Misc. No.23513 of 2016 (4) dt.05-08-2016 2/2 Misc. No. 1662 of 2012.

On behalf of the State, it is submitted that the petitioner is not named in the FIR.

In the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions JudgeV,Patna, in connection with Ram Krishna Nagar P.S.Case No. 28 of 2011 (Tr.No. 1380 of 2011).
