The petitioner seeks bail in connection with Laukahi P. S. Case No.151 of 2021, instituted for the offences under Sections 272, 273 read with Section 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 21.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery of 450 litre of liquor from Budhan Yadav, who disclosed that the liquor was to be supplied to the petitioner and one another.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.58077 of 2021(2) dt.07-01-2022 2/2 petitioner has been falsely implicated in the case at the behest of Budhan Yadav, with whom he is on an inimical term. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 21.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Laukahi P. S. Case No.151 of 2021.

The application stands allowed.
