2. learned counsel for the petitioner is permitted to file supplementary affidavit in course of the day and the same is kept on record.
3. The petitioner has preferred this application for grant of regular bail in connection with Khajekelan P.S. Case No. 05 of 2024 dated 03.01.2024 registered for the offences punishable u/ss 147, 149, 341, 323, 307, 379, 325, 504, 506 read with section 34 of the Indian Penal Code.
4. As per the prosecution case, the petitioner and the co-accused persons are alleged to have abused and assaulted the informant with intention to kill. The husband of the co-accused
Patna High Court CR. MISC. No.52517 of 2024(2) dt.30-07-2024 2/3 Sangeeta Devi assaulted the informant with the butt of pistol due to that his left shoulder got fractured. It is further alleged that they took the informant to the next roof and snatched Rs. 8,000/-, key, two ATM cards and Aadhar card and also assaulted him with iron rod causing broken injury on his chest and Panjara and thereafter, they threw him from the roof.
5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a delay of five days in lodging the FIR. There is case and counter case between the parties. As per the injury report, no any external visible injury was found on the person of the injured. The informant did not sustain injury on his shoulder. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 16.05.2024.
6. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna City, Patna in connection with Khajekelan
