2. The petitioner seeks pre-arrest bail in connection with Gopalpur P.S. Case No. 194/2019 registered for the offence(s) punishable under Sections 341/323/324/379/504/307/34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the accused persons named therein including the petitioner entered into the house of the informant and assaulted brutally the entire family members including the informant. Specific allegation is against co-accused Salma Khatun, Abdulla Ansari and Haider Ali.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.51924 of 2024(2) dt.28-08-2024 2/2 petitioner submitted that from perusal of the FIR, it would appear that allegation against the petitioner is general and omnibus and he has not assaulted the informant or any of his family members. Petitioner has clean antecedent.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. Considering the nature of allegation made in the FIR, as well as, the same being general and omnibus so far as petitioner is concerned, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-V, Gopalganj in connection with Gopalpur P.S. Case No. 194/2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Purnendu Singh, J) Sanjay/- U T
