JUSTICE SUDHIR SINGH ORAL ORDER 08-06-2015 It is alleged by the informant that her daughter Juli Kumari, aged about 15 years was living in her maternal grandfather's house and on 10-1-2015 she went to Kamla Nehru School for study and from where she was kidnapped by coaccused Ravi Kumar, his brother, Rajan Kumar(petitioner), sister Priyanka Kumari and Dharmendra Malakar for the purpose of marriage. In course of search the informant went at the house of accused, Ravi Kumar, where his family assured her for return of her daughter.

It has been submitted on behalf of the petitioner that the main allegation is against one Ravi Kumar. He has enticed the victim for the purpose of marriage, and the name of the petitioner appears on the basis of suspicion. Further, Annexure-2 to the

Patna High Court Cr.Misc. No.15406 of 2015 (2) dt.08-06-2015 application shows that the statement of the victim under section 164 Cr.P.C. was recorded where the petitioner has not been named.

Further, it has been submitted that the petitioner is in custody since 24-1-2015, and the petitioner has no criminal antecedent.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the facts and circumstances of the case, let the petitioner Rajan Kumar be released on bail on furnishing bail bond of rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Nalanda at Biharsharif, in connection with Noor Sarai P.S. Case No. 12/15 corresponding to G.R. No. 175/15.
