Earlier the notice was issued to the opposite party by order dated 20.08.2014 and Mr. Binay Kant Mani Tripathi, has appeared for the sole opposite party.

After hearing the parties and considering the averments made in the restoration application, the restoration application is allowed and the S.A. No. 31 of 2005 is restored to its original file subject to the payment of cost of Rs. 10,000/- to the sole opposite party within a period of two weeks from today. The cost shall be paid to Mr. Binay Kant Mani Tripathi, the learned counsel for the sole opposite party who shall grant a receipt to the appellant for the same, on behalf of the opposite party.

If the aforesaid cost is paid within the aforesaid
