JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-04-2015 Heard both sides. The petitioner seeks bail in Sahebpur Kamal P.S. Case No. 267 of 2014 registered under Section 302 and other Sections of the I. P.C.

The wife of the deceased alleged that while her husband was going to Petrol Pump and no sooner reached near the house of Shankar Sah, Parshuram Sah, Savitri Devi the petitioner dragged him inside their house and brutally assaulted him. The accused persons also took out his eyes.

Shri Viveka Nand Singh, learned counsel for the petitioner, submits that the petitioner is a lady and there is no allegation of assault against her. Only allegation is that she also

On perusal of the record, it appears that the petitioner and other accused persons not only dragged the deceased inside their house but also committed brutal murder of the husband of the informant. From perusal of the post mortem report, it appears that as many as ten injuries were found on the body of the deceased Ram Dayal Sah and his eyes were also taken out. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected in Sahebpur Kamal P.S. Case No. 267 of 2014, pending in the court of the learned J.M. Ist Class, Begusarai. The Trial Court is directed to expedite the trial and conclude the same within one year from the date of receipt of this order.
