JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-11-2017 Heard learned counsel for the petitioners and learned counsel for the informant as well as learned Additional P.P. This application, for grant of anticipatory bail, arises out of Rohtas Mahila P.S. Case No. 49/2017, disclosing offences under Sections 420 and 506/34 of the Indian Penal Code. The allegation against the petitioner is that after finalization of the marriage negotiations and the completion of ring ceremony, the petitioner and the family members refused to marriage of the petitioner with the informant on the ground that the family members of the informant had criminal antecedent.
Learned counsel for the petitioner has submitted that the petitioner is ready to pay a sum of Rs. 6 lacs to settle the entire dispute.
Patna High Court Cr.Misc. No.48775 of 2017 (2) dt.16-11-2017 2/2 Learned counsel for the informant informs this Court that the police have already submitted charge sheet. He submits that with the Court's intervention, the dispute between the parties may be resolved.
I do not think intervention, at this level, by this Court is required. Since the investigation is complete, no purpose will be served, if, now the petitioner is taken into custody. Accordingly, this application is allowed. Let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Rohtas Mahila P.S. Case No. 49/2017, subject to the condition laid down under Section 438(2) of the Cr.P.C.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
