The petitioner apprehends his arrest in Complaint Case No. 36(C) of 2019, registered for the offences punishable under Sections 323, 504 and 506 of the Indian Penal Code and Section 138 of the N.I. Act.

The petitioner is said to have purchased the gold chain, ring and bangle worth Rs.1,00,000/- and thereafter the petitioner gave a cheque of Rs.1,00,000/-, but the cheque got dishonoured. Again the petitioner gave another cheque of Rs.1,00,000/- but the same also got dishonoured and when the complainant demanded his money, the petitioner abused and assaulted the complainant. Learned counsel for the petitioner submits that the petitioner has already paid Rs.20,000/- to the complainant and rest

Patna High Court CR. MISC. No.51190 of 2019(6) dt.20-06-2022 2/2 amount, i.e., Rs.80,000/- shall be paid in eight equal installments (rupees ten thousand per month).

Taking into consideration the fact aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six seeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi in connection with Complaint Case No. 36(C) of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.

It is made clear that if Rs.80,000/- (rupees eighty thousand) is not paid by the petitioner to the complainant in eight equal installments (rupees ten thousand per month), the learned court below is directed to cancel the bail bond of the petitioner. (Anjani Kumar Sharan, J.) Sanjay/- U T
