JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report and it is alleged that he along with other F.I.R named accused mercilessly assaulted the informant as informant failed to meet the illegal demand of petitioner and his associates. It is also stated that some cash was snatched from the informant by the petitioner. Submission on behalf of the petitioner is that petitioner is said to be caught on the place of occurrence, just after the alleged occurrence, but even if the prosecution story is assumed to be true, then also, no specific overt act has been attributed against the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Muffasil P.S.Case No. 138 of 2016.
