The petitioner seeks bail in a case registered under Sections 147, 148, 149, 307, 384, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
Allegation is that the accused persons having armed with deadly weapons came at the door of the informant and started using abusive language and started indiscriminate firing. assaulted the informant by means of garasa on his head, due to which he sustained injuries.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged
Patna High Court CR. MISC. No.44729 of 2019(2) dt.22-07-2019 2/2 against the petitioner. Specific allegation is against co-accused Shravan Kumar, Fucho Kumar and Santosh Kumar for committing an offecne under Section 384 of I.P.C. So far the injury is concerned, none is said to have been injured in course of occurrence. Hence, no offence under Section 307 of the I.P.C. is made out.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Naugachia, District Bhagalpur in connection with Bihpur P.S. case No.141 of 2019.
