JUSTICE BIBEK CHAUDHURI ORAL ORDER 22-07-2024 The grievance of the petitioner is that the petitioner did not receive her salary intermittently for one day in the month of July 2017, one day in the month of 2017, two days in the month of December 2017, 20 days in the month of Marchand 20 days in the month of April 2018. It is also found from Annexure 3 that she was transferred to District Hospital, Munger but, she did not join her place of transfer and had been working in the Sub-Divisional Hospital at Tarapur. The Superintendent In-charge of Sub-Division Tarapur, Munger wrote a letter to Civil Surgeon-Cum-Chief Medical Officer,

Patna High Court CWJC No.10738 of 2024(2) dt.22-07-2024 2/2 Munger to give his considered opinion as to whether the petitioner is entitled to get salary for the aforesaid days and months. The Civil Surgeon-Cum-Chief Medical Officer did not send any reply till date.

2. In view of such circumstances and after having heard the learned Advocate for the petitioner as well as the State respondents, I am not inclined to dispose of the instant writ petition, directing the Civil Surgeon-Cum-Chief Medical Officer, Munger, to make a reasoned communication to the Superintendent In-charge of Sub-Divisional Hospital Tarapur, Munger within 30 days from the date of communication of this order.

3. The instant writ petition is disposed of, in accordance with the above direction.

4. The petitioner is at liberty to act on the server copy of the order.
