20-08-2016 Heard Sri Shivendra Kumar Sinha, learned counsel for the petitioner, learned Addl. Public Prosecutor as well as Sri Ajit Kumar Singh, learned counsel, who has voluntarily appeared on behalf of informant.

The petitioner, who is in custody in Mufassail P.S. Case No. 230 of 2015 registered for offence under Sections 341, 342, 504, 302, 109/34 of the Indian Penal Code and Section 27 of the Arms Act, 1959, corresponding to Sessions Trial No. 41 of 2016, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that though, there is allegation of firing against the petitioner, the petitioner has falsely been implicated in the present case, whereas, learned counsel for the informant submits that there is specific accusation against the petitioner. He further submits that in this

Patna High Court Cr.Misc. No.34616 of 2016 (2) dt.20-08-2016 2/2 case, trail has already commenced and one prosecution witness has already been examined and discharged.

In view of nature of accusation as well as the fact that trial has already commenced, there is no reason to extend the privilege of bail.
