The petitioner seeks bail in a criminal prosecution registered under Section 307 and some other allied offences of the Indian Penal Code as also under Section 27 of the Arms Act in which subsequently offence under Section 302 of the Indian Penal Code was also added.
Taking into consideration the fact that the petitioner is alleged to have killed his own son and he is accused in two other criminal cases besides the present one, this Court is not inclined to accede to the prayer made on behalf of the petitioner for grant of bail at this stage. Accordingly, his prayer for bail in connection with Sikandra P.S.Case No. 159 of 2014 pending in the court of Judicial Magistrate, Ist Class, Jamui is rejected. Learned Judicial Magistrate, Ist Class, Jamui, who is in seisin of the criminal case, is directed to commit the case of the petitioner to the court of session, if not already committed.
