2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 379, 427, 504 & 506 read with Section 34 of the I.P.C together with Section 27 of the Arms Act.

3. As per the prosecution case, the F.I.R. has been lodged against 5 named and many unknown accused persons. The allegation against the petitioner is to assault the informant by knife, due to which injury took place.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that there are 3 injuries on the head of the informant and there was also a bruise found on his head. Counsel submits that

Learned counsel for the petitioner further submits that actually petitioner is a candidate of Zila Parishad and on the day of occurrence, election was going on and relating to the same date and place of occurrence, the rival group attacked on the petitioner. In this regard, he has filed a case. Counsel submits that the petitioner has also filed a Hisua P.S. Case No. 676 of 2021 against the informant's side.

6. Learned counsel for the petitioner further submits that there is a case and counter case. Counsel submits that in the case filed by the petitioner, there were 31 named persons were made accused. Counsel submits that this dispute has caused due to election and nothing else. Counsel fairly submits that there are 2 criminal antecedents of the petitioner in which he is on bail. Counsel submits that the petitioner is a law abiding citizen.

7. Learned A.P.P. for the State opposes the prayer for bail.

8. In the present facts and circumstances of the case and the submissions made above, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 6 weeks from today, on furnishing bail bonds of Rs.30,000/-

No. 48448 of 2023(2) dt.11-08-2023 3/3 (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada in connection with Hisua P.S. Case No. 675 of 2021, dated 30.11.2021 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
