JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The informant lodged the present case on 11.07.2015 in respect of missing of his son. Subsequently, when further statement of informant was recorded, he disclosed that prior to the alleged occurrence, petitioner and one Md. Raja had given threatening to him. Subsequently, on 14.07.2015 the dead body of the informant's son was recovered from an orchard and, thereafter, the statement of the informant was again recorded at para-27 of the case dairy in which he stated that in course of search of his son, co-accused Md. Raja disclosed him the name of the petitioner and also the manner in which deceased was killed. Subsequently, Md. Raja was arrested by the police and he too made his
Patna High Court Cr.Misc. No.23511 of 2016 (3) dt.12-07-2016 2/2 confessional statement before the police. It appears that except the aforesaid material, there is nothing against the petitioner. Moreover, the investigation against the petitioner has already been completed.
Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Barh, Patna in connection with Session trial no. 925 of 2015 arising out of Bakhtiyarpur P.S.Case No. 173 of 2015.
