JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-10-2018 In view of the subsequent development, that is, conversion of the Rajendra Agricultural University as Dr. Rajendra Prasad Central Agricultural University, the writ application against the successor University is unsustainable. Mr. Arvind Ujjwal, learned counsel appearing for the University submits that in terms of the Memorandum of Understanding and the Act, the controversy as to the liability of pre-2016 is against the State Government and Dr. Rajendra Prasad Central Agricultural University is not in any manner
Patna High Court CWJC No.19624 of 2012(4) dt.25-10-2018 2/2 responsible for pre-acquisition liability of the University and those liabilities are now against the State of Bihar. Considering the aforesaid, the writ application is disposed of with liberty to the petitioner to approach the State Government for redressal of his grievance who is said to have retired without getting the benefit of promotion under the Rajendra Agricultural University. In the event the petitioner files such representation addressed to the Principal Secretary, Agricultural Department, Govt. of Bihar, the Principal Secretary shall consider the representation and pass appropriate order in terms of the Memorandum of Understanding under which the Rajendra Agricultural University has been converted as Dr. Rajendra Prasad Central Agricultural University.
Necessary decision in this regard must be taken by the Principal Secretary, Department of Agriculture, Govt. of Bihar expeditiously, preferably within a period of four months from the date of receipt/production of a copy of this order. (Anil Kumar Upadhyay, J) mrl.
