Petitioner is in jail custody since 13.6.2001 in a case registered under section 302 and other minor sections of the Indian Penal Code, section 17 C.L.A. Act and various sections of the Arms Act.

Submission on behalf of the petitioner is that having similar allegation some co-accused have already been granted privilege of bail and there is no likelihood of conclusion of trial of the petitioner in near future as it is evident from perusal of the report of learned court below. It is further submitted that no specific overt-act has been attributed against the petitioner and the impugned order goes to show that in course of investigation, it has only come in evidence that the petitioner was carrying stengun at the time of alleged occurrence.
