2. The petitioner is in custody in connection with Mahua P.S. Case No. 198 of 2023 for the offence under Sections 328, 302 and 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner has got one criminal antecedent and he is in custody since 02.04.2023.

4. As per prosecution case, the deceased was killed by accused persons including the petitioner.

5. During investigation, no injury has been found upon victim. The prosecution has filed a compromise petition that deceased has died in an accident and the case was lodged against accused persons mistakenly.

6. Considering the aforesaid facts and period of custody, the petitioner, named above, is directed to be released

Patna High Court CR. MISC. No.52831 of 2023(2) dt.23-08-2023 2/2 on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M, Vaishali at Hajipur in connection with Mahua P.S. Case No. 198 of 2023.
