This application for regular bail arises out of Pipra P.S. Case No. 293 of 2020, disclosing offences punishable under Sections 272/273/120-B/34 of the Indian Penal Code and Sections 30(a), 36, 41(i) of Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 25.08.2020. His application for regular bail was earlier rejected by an order dated 04.03.2021, passed in Cr. Misc. No. 33169 of 2020. Allegedly, from a place in petitioner's possession 3000 litres of spirit was recovered. While rejecting the petitioner's prayer for regular bail earlier, it was observed that if no charge was framed within six months from the date of the order, he shall be at

Patna High Court CR. MISC. No.57817 of 2021(2) dt.24-11-2021 2/2 liberty to renew his prayer for bail.

It has been stated in the present application that no charge has been framed so far.

Considering the observation made in the order dated 04.03.2021, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Additional Sessions Judge7th-cum-Special Judge, Excise, East Champaran, Motihari in Pipra P.S. Case No. 293 of 2020.
