JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Sakurabad Police Station Case No.70 of 2019 registered for the offences punishable under Sections 304, 337 and 338 of the Indian Penal Code.

As per F.I.R., the petitioner and other co-accused persons had put a naked electric wire in their maze field and one of the daughter of the informant while playing thereat came in contact with the said naked wire and died.

Submission of learned counsel for the petitioner is that he is not residing there and he has not put the naked wire in the field and one accused is in custody.

Heard learned A.P.P. and learned counsel appearing on behalf of the the informant, who opposed the prayer for anticipatory bail on the ground that material collected during

Patna High Court CR. MISC. No.44592 of 2019(4) dt.24-10-2019 2/2 investigation also shows that a naked wire was brought through the maize field and due to that the daughter of the informant received electric shock and subsequently died. Having heard both sides and in view of the above allegation as discussed above, I am not inclined to grant privilege of anticipatory bail to the petitioner, above named. However, if the petitioner surrenders and pray for regular bail, the same shall be considered on its own merit and if possible dispose of on the same day.
