JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 364/34 of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected vide a detailed order dated 28.05.2020 passed in Cr. Misc. No.29 of 2020. This the second attempt of the petitioner for grant of prayer for bail.
Vide order dated 07.04.2021 a report was called for from the learned Court below regarding the stage of trial. In compliance thereof, a report, which is at flag 'Z', has been received. Apart from the other facts, in the report, it is stated
Patna High Court CR. MISC. No.4083 of 2021(5) dt.28-07-2021 2/2 that five witnesses have been examined till date. In the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. The prayer for bail is hereby once again rejected. However, the learned Trial Court is directed to conclude the trial as expeditiously as possible, preferably within nine months of the normal functioning of the physical Court proceeding.
