The petitioner apprehends his arrest in connection with Bodhgaya P.S. Case No. 396 of 2017 registered under Sections 341, 323, 325, 326, 307, 337, 506, 34 of the I.P.C. and 3⁄4 of the Dian Act pending in the Court of C.J.M., Gaya. Submission is that petitioner is innocent and has committed no offence as alleged in the F.I.R. The occurrence took place due to land dispute.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that there is direct allegation of assault by means of sharp cutting weapon against the petitioner. The witnesses have also supported the

Patna High Court Cr.Misc. No.46493 of 2017 (3) dt.15-11-2017 2/2 prosecution version.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
