2. The petitioner is seeking regular bail in connection with Raghopur P.S. Case No. 420 of 2024, registered for the offences punishable under Sections 310(4), 310(5) of the BNS, 2023 and Sections 25(1-B)a/26/35 of the Arms Act.
3. As per allegation, three accused persons, namely Prakash Kumar, Ajay Sirgil (the petitioner) and Rahul Sain, were arrested. From possession of Prakash Kumar, a countrymade loaded pistol was recovered and from possession of this petitioner, a live cartridge, a mobile set, and Rs. 5,000/- were recovered. From possession of Rahul Sain, a live cartridge and a mobile set were also recovered.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.48880 of 2025(2) dt.11-08-2025 2/2 that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner is a person of clean antecedent and is under custody since 14.12.2024.
5. On the other hand, the learned APP for the State has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, especially the period of custody and clean antecedent, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM, Birpur Supaul in connection with Raghopur P.S. Case No. 420 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
7. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if it is found that he is involved in any other case except the present one, his bail bond shall not be accepted. (Nawneet Kumar Pandey, J) Nirmal/- U T
