JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 29-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Amdabad P.S. Case No. 75 of 2007 registered under Sections 396, 397, 325, 353, 307 and 412 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation the name of the petitioner has come in the confessional statement of co-accused, Sk. Akthar except that there is nothing against the petitioner. Further submission is that though the informant has claimed to identify the culprits on seeing them again but the petitioner has not been put on T.I. Parade while he is

Patna High Court Cr.Misc. No.9181 of 2016 (2) dt.29-03-2016 in custody since 15.12.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Katihar, in connection with Amdabad P.S. Case No. 75 of 2007. Out of two sureties, one surety must be the close relative of the petitioner.
