JUSTICE SANJAY PRIYA ORAL ORDER 28-08-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sidhwalia P.S. Case No. 85 of 2017, G.R. No. 2442 of 2017 instituted for the offence under Sections 341, 323, 307, 379 and 34 of the Indian Penal Code.
It is alleged in the written report that this petitioner assaulted the informant on his head and shoulder with iron rod causing injury in his head and he fell down.
The injury report has been enclosed as Annexure-2 wherein the Doctor has found total five injuries on the person of the injured caused by hard and blunt object.
It is mentioned in paragraph-3 of the bail petition that petitioner has criminal antecedent.
Patna High Court Cr.Misc. No.38858 of 2017 (2) dt.28-08-2017 2/2 In such circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail which shall be disposed off by the court below on the same day in accordance with law without being prejudiced by this order.
