The petitioner seeks bail in S.Tr. No. 151 of 2021, arising out of Naubatpur P.S. Case No. 404 of 2020, registered for the offence under Section 392 of the Indian Penal Code. As per the prosecution case, on 05.08.2020 at 9.45 pm, while driver of the informant was returning on tractor after selling the sand, on the way, three bike borne miscreants intercepted him and thrashed his driver and took away his tractor.

It is submitted on behalf of the petitioner that name of this petitioner has come during course of investigation on the basis of self confessional statement of petitioner recorded in Bikram PS case No. 192/2020. No looted article has been recovered from possession of this petitioner. Till date, petitioner

Patna High Court CR. MISC. No.57819 of 2021(2) dt.03-02-2022 2/2 has not been put on T.I.P. so as to connect him with the aforesaid crime. Petitioner is in custody since 08.09.2020. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge III, Danapur, Patna in connection with S.Tr.
