JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-05-2015 Heard learned counsel for the petitioner as well as learned APP for the State.

On having been informed regarding assemblage of antisocial elements, a raid was conducted and during course thereof, four persons were apprehended. On search, from the possession of Afzal Khalifa, one country made loaded pistol was recovered while from the possession of Vipul Kumar Rai and Dilwar Khan (petitioner), cartridges have been shown to be recovered.

Petitioner has got no criminal antecedent and he is under custody since 28.08.2014.

In the aforesaid facts and circumstances of the case, petitioner, Dilwar Khan is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-3rd, Kaimur at Bhabua in Sessions Case No. 437 of 2014/4973 of 2014 arising out of Bhabua PS Case No.395/2014.
