The petitioner seeks bail in connection with Kudra P.S. Case No. 127 of 2016 registered for the offences punishable under Section 120 (B) of the Indian Penal Code and Section 47, 54, 57 and 63 of the Excise Act.
Prosecution case is that on secret information, the police party raided the house of Dharmendra Kr. Singh and recovered 274 bottles of different makes of foreign liquor containing 79.20 litres.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner has falsely been implicated in the present case and he is languishing in custody since 26.09.2016. The petitioner is only the owner of the
Patna High Court Cr.Misc. No.49846 of 2016 (2) dt.13-12-2016 2/2 house which he has given on rent to open licence liquor shop. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Kaimur at Bhabua in connection with Kudra P.S. Case No. 127 of 2016.
