2. It is the claim of the petitioner that the said Parma

Patna High Court CWJC No.17192 of 2016 dt.03-11-2017 2/2 Middle School satisfies all the requirements for up-gradation, as per Middle School, under the policy of the State Government, as contained in office order, issued by the Director, Secondary Education, Government of Bihar, vide Memo No. 1648, dated 27.08.2015.

3. This Court does not have judicially determinable parameters to conclusively hold as to which of the two schools deserves to be up-graded, under the State policy. It is purely an executive matter, which can be decided at that level only.

4. This application is disposed of accordingly with the only observation that the respondents should act fairly and dispassionately to implement the scheme of the State Government while selecting as to which school should be up-graded.
