The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

Prosecution case is that the dead body of the son of the informant was found near Markuria Cannel. The informant has apprehension of previous enmity of his family members and co-accused Jainarayan Pandit is the main conspirator of the incident.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is no direct evidence against the petitioners and it is a case of purely suspicion against the

He further submits that the Investigating Officer on a conclusion that Sikandar Pandit, Manik Lal Pandit, Jainaryan Pandit, Sunil Kumar, Subodh Kumar and Anil Kumar have no role in the present case, therefore, police submitted final form in favour of these accused persons vide Final Form No.100 of 2021 dated 03.06.2021 in which he has clearly stated that these accused persons have no involvement in these case as stated in para-13 of the petition. Petitioners have got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Supaul in connection with Triveniganj P.S. Case No. 388 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
